What is Liquor Liability Insurance?

Liquor Liability Insurance provides coverage for legal fees, medical costs, and settlements associated with bodily injury or property damage caused by an intoxicated person, who was served or sold liquor by the policyholder “Licensee”. The businesses in need of a Liquor Liability Insurance policy include liquor stores, bars, taverns, restaurants, convenience stores, breweries, wineries, grocery stores, nightclubs, private clubs, bowling alleys, etc. Regardless of its size, any business that sells/serves alcohol is exposed to a liquor liability claim.

The Michigan Liquor Control Code of 1998 (Dram Shop Act), provides a cause of action against a retail licensee who unlawfully serves alcoholic beverages to an intoxicated person or minor, and which results in injury, death or property damage to an innocent third party.

(Fun Fact: The Dram Shop Act was named after establishments in 18th century England that sold gin by the spoonful, also known as dram. )

LARA is Michigan’s licensing and regulatory affairs department; responsible for making sure liquor laws are being upheld and to code. Michigan’s liquor law requires proof of liquor liability insurance which is also called Proof of Financial Responsibility. Submitting proof of liquor liability insurance to the Michigan Liquor Control Commission (MLCC) is done so by filling out the LC-95 form, which is required by MCL 436.1803

Proof of Financial Responsibility (LC-95) certifies that the Licensee has coverage of no less than $50k in Liquor Liability Insurance.
